The New Reassigned Number Database, the FCC and the Bona Fide Error Defense

The CFPB’s Debt Collection Rule provides a bona fide error (BFE) defense from third-party communications liability. The text message BFE defense requires using a “complete and accurate database” to confirm that the consumer’s telephone number has not been re-assigned.
The CFPB identified the FCC’s Reassigned Numbers Database to comply with the BFE requirement.
