A couple of weeks ago, the CFPB issued a press release that indicated discrimination can trigger liability under unfair acts and practices. As part of this announcement, they updated the exam manual on Unfair, Deceptive, or Abusive Acts or Practices to include an extra focus on discriminatory practices. At first glance many assumed this does not apply to our industry. Not only does it apply but this focus goes much further than just examinations.
