This webinar provides an in-depth review of federal regulations governing debt collection practices. Attendees will gain a comprehensive understanding of the Fair Debt Collection Practices Act (FDCPA), including its purpose to eliminate abusive practices, ensure fair competition, and protect consumers. Key principles such as "Don't lie and don't be a jerk" will be discussed, along with enforcement by the FTC, CFPB, and private lawsuits. The session will cover restrictions on communication, harassment, false representations, required disclosures, and the Least Sophisticated Consumer Standard. Additionally, participants will learn about Unfair, Deceptive, Abusive Acts, or Practices (UDAAP), penalties for violations, and consumer disclosures like Mini-Miranda warnings and Model Validation Notices (MVN).

Crystal M. Duplay has dedicated her legal career to the field of Creditor’s Rights, representing clients in all facets of debt collection. She holds a Bachelor of Arts degree from Baldwin Wallace University and earned her Juris Doctor from the Cleveland-Marshall College of Law at Cleveland State University.

Crystal is a frequent speaker and published author on a wide range of debt collection topics. She currently serves as Secretary of the Ohio Creditor’s Attorney Association and is a member of the Board of Directors for the National Creditors Bar Association (NCBA). She is licensed to practice law in Ohio, Wisconsin, and before the Supreme Court of the United States.

Dean Mackert
Mountain Peak Law Group, PC
Dean was born and raised in Fort Worth, Texas. In 2008, he graduated Cum Laude from Baylor University, where he was Pre-Law student and majored in Religious Studies. A few years later, Dean received his J.D. from The University of Oklahoma School of Law and was admitted to the Texas Bar in 2012. In 2014, he passed the Oklahoma bar exam and began practicing Oil & Gas Law in both Texas and Oklahoma. From 2014 through 2020, he issued ownership reports and published numerous complex Oil & Gas Title Opinions across various Oklahoma counties for some of the industry’s biggest production companies.

In 2021, Dean transitioned his field of practice to Creditor’s Rights Law in Oklahoma and Texas, attending countless trials and hearings across multiple counties in both states. In 2024, he joined Mountain Peak Law Group and currently serves as the associate attorney for collections efforts in Colorado and Oklahoma.

In his free time, Dean likes watching college and professional sports and enjoys studying history, economics, and financial markets.

CLE Information

National Creditors Bar Association is a national provider of legal educational content. NCBA’s goal is to provide its members with as many opportunities as possible to earn Continuing Legal Education (CLE) credits. Some NCBA webinars state that they are pending approval. If a webinar is pending approval, it means that NCBA’s education staff is awaiting confirmation of approval for CLE credit from the accrediting body of a particular state; it should be noted that individual states have different response and approval rates. NCBA expects that the course will be approved for the credit amount and type listed, but approval is not guaranteed. An attorney can still take the course at their own discretion, though.

It is not uncommon for a course which is pending approval to not be approved until after the webinar has taken place. Once an official decision notice arrives from the state, NCBA will notify attorneys who have completed the course as soon as possible via email, and will re-issue any certificates of completion to reflect the updated state reporting numbers. However, it is recommended that attorneys do not view webinars that are pending approval close to their CLE deadline, as NCBA cannot guarantee that a course will be approved in time.

National Creditors Bar Association will seek MCLE accreditation, with the assistance of the ABA MCLE, for this webinar. NCBA will seek General CLE credit hours in 60-minute-hour states, and in 50-minute states, subject to each state’s approval and credit rounding rules. States typically decide whether a program qualifies for MCLE credit in their jurisdiction 4-8 weeks after the program application is submitted. For many live events, credit approval is not received prior to the program. A link for CLE requests will be provided to webinar attendees who have met the attendance and engagement requirements.
